Terms and Conditions for Nanpure

1. Agreement to Terms

Welcome to Nanpure (“App,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the Nanpure mobile application, available on iOS and Android platforms.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Nanpure is a mobile puzzle game application that provides:

  • Classic Sudoku puzzles across multiple difficulty levels (beginner to expert)
  • Features including pencil mode, undo functionality, eraser tool, and Magic Hints
  • Support for multiple languages (English, German, French, Italian, Spanish)
  • Light and dark mode themes
  • Sounds and haptic feedback options
  • Scoring system and progress tracking

3. Eligibility

The App is available to users of all ages. No account creation or personal information is required to use the App. If you are under the age of 18 (or the age of majority in your jurisdiction), you may use the App with the consent of a parent or legal guardian.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal mobile device
  • Use the App for personal, non-commercial purposes

This license does not include the right to:

  • Modify, adapt, or create derivative works based on the App
  • Reverse engineer, decompile, or disassemble the App
  • Copy, reproduce, or distribute the App
  • Sell, rent, lease, or sublicense the App
  • Use the App for any commercial purpose without our prior written consent

5. Intellectual Property Rights

Our Content

All content in the App, including but not limited to:

  • Sudoku puzzles and puzzle designs
  • Graphics, images, and visual elements
  • User interface design and layout
  • Sound effects and music
  • Text, logos, and branding
  • Software code and algorithms

is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

Trademarks

“Nanpure” and any associated logos are trademarks of Billy’s App Studio. You may not use these trademarks without our prior written permission.

6. User Conduct

You agree not to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App or servers connected to the App
  • Introduce viruses, malware, or other harmful code
  • Use automated scripts or bots to interact with the App
  • Exploit any bugs or vulnerabilities in the App
  • Circumvent any security measures or access controls

7. Game Progress and Data

Local Storage

Your game progress, scores, settings, and preferences are stored locally on your device. We are not responsible for any loss of data due to:

  • Device malfunction or damage
  • App uninstallation
  • Operating system updates
  • Clearing App data or cache

No Warranty of Data Preservation

We do not guarantee the preservation of your game progress or scores. We recommend regularly backing up your device according to your device manufacturer’s instructions.

8. In-App Purchases (If Applicable)

If the App offers in-app purchases:

  • All purchases are final and non-refundable, except as required by applicable law
  • Purchases are processed through the Apple App Store or Google Play Store
  • Refund requests must be directed to the respective app store
  • We are not responsible for unauthorized purchases made through your device
  • Prices are subject to change without notice

9. Advertisements

Nanpure is designed to be ad-free during gameplay. Your gaming experience will not be interrupted by third-party advertisements.

10. Third-Party Services

The App may integrate with third-party services such as:

  • Apple App Store
  • Google Play Store
  • Firebase Analytics

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

11. Updates and Modifications

We reserve the right to:

  • Update, modify, or discontinue the App at any time without notice
  • Add, change, or remove features or content
  • Require you to update the App to continue using it

We will make reasonable efforts to notify you of significant changes through the App or app store listings.

12. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT

WE DO NOT WARRANT THAT:

  • The App will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • The results obtained from using the App will be accurate

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your access to or use of the App
  • Damages resulting from any unauthorized access to our servers
  • Any interruption or cessation of transmission to or from the App

Our total liability for any claims arising from or related to the App shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Billy’s App Studio and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

15. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

  • Your license to use the App will immediately cease
  • You must delete the App from your device
  • Provisions that by their nature should survive termination will survive

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the App shall be resolved through:

  1. Informal Negotiation: We encourage you to contact us first to resolve any disputes informally.
  2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements or communications.

20. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms within the App
  • Updating the “Last Updated” date at the top of this document

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
